Welcome to Quiet Bloom. The terms “we”, “us” and “our” refer to Quiet Bloom – Floral Studio (“Quiet Bloom”). Quiet Bloom operates this store and website, including all related information, content, features, tools, products and services (the “Services”). Quiet Bloom is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service (“Terms”), together with any policies referenced in them, explain your rights and responsibilities when you use our Services. By visiting, interacting with, or purchasing from our store, you agree to these Terms and our Privacy Policy and Refund Policy and Delivery Policy (collectively, our “Policies”). If you do not agree, please do not use our Services.


1) ACCESS & ACCOUNT

By using our Services, you confirm you are at least the age of majority in your state or territory of residence, and you have consent to allow any minor dependents to use the Services on devices you own or manage.

To place an order, you may be asked to provide details such as your email address, billing, payment, and delivery information. You confirm the information you provide is accurate and complete and that you have the right to provide it. You are responsible for maintaining the security of your account and for all activity under your account.


2) OUR PRODUCTS (FLORAL & GIFT ITEMS)

We do our best to represent products accurately. However, colours and appearance may vary depending on lighting, seasonal availability, and your screen/device.

Seasonal substitutions: Flowers and materials are subject to availability. Where necessary, we may substitute flowers, colours, or packaging with items of equal or greater value while maintaining the overall style and feel of the arrangement.

All product descriptions, pricing, and availability may change at any time without notice.


3) ORDERS

When you place an order, you are making an offer to purchase. Quiet Bloom may accept or decline an order at its discretion (for example: stock availability, delivery constraints, suspected fraud, or pricing errors).

An order is confirmed once payment is processed and you receive an order confirmation from us. Please check your order details carefully before submitting—after confirmation, changes or cancellations may not be possible, especially for same-day delivery items.

Refunds, replacements, and disputes are handled according to our Refund Policy and Delivery Policy.

Orders are for personal gifting or household use only (not for commercial resale).


4) PRICES, TAX & BILLING

All prices are in Australian Dollars (AUD).

Delivery fees (if any) are calculated at checkout based on suburb and distance and may vary by time slot.

You agree to provide current and accurate payment and contact information. If we discover a pricing error, we may cancel the order and refund you, or contact you to confirm whether you wish to proceed at the corrected price.


5) DELIVERY, TIME WINDOWS & RECIPIENT RESPONSIBILITY

Delivery availability and fees are shown at checkout (where available). Delivery times are provided as estimated windows and are not guaranteed. Peak periods (e.g., Valentine’s Day, Mother’s Day, public holidays) may have limited capacity and longer time windows.

Recipient not home / no safe place:
If no one is available to receive the order, we will follow any delivery instructions provided at checkout where possible. If there is no safe place to leave the order, re-delivery or redirection may incur additional fees.

Delivery address accuracy:
You are responsible for providing a correct delivery address and recipient contact details. If delivery fails due to incorrect details, re-delivery fees may apply.

Weather & handling:
Flowers are perishable. Once delivered to the address provided (and left in accordance with instructions), responsibility transfers to the recipient/customer.

6) INTELLECTUAL PROPERTY

All content on our Services (including text, images, graphics, logo, product photos, and website design) is owned by Quiet Bloom or its licensors and is protected by Australian and international intellectual property laws. You may not copy, reproduce, or use our content for commercial purposes without our written permission.

Shopify names and trademarks belong to Shopify.


7) OPTIONAL TOOLS

We may provide access to third-party tools or integrations. We provide them “as is” and “as available” without warranties. Your use of third-party tools is at your own risk.


8) THIRD-PARTY LINKS

Our Services may include links to third-party websites. We are not responsible for third-party content, policies, or services.


9) RELATIONSHIP WITH SHOPIFY

Quiet Bloom is powered by Shopify. However, purchases are made directly with Quiet Bloom. Shopify is not responsible for the sale, fulfilment, delivery, or condition of products purchased from Quiet Bloom.


10) PRIVACY

Your personal information is handled according to our Privacy Policy. Because our store is hosted by Shopify, Shopify may process certain information to provide the Services.


11) FEEDBACK & REVIEWS

If you submit reviews, suggestions, or feedback, you grant Quiet Bloom a worldwide, royalty-free licence to use, reproduce, and display that Feedback for business purposes (including marketing). You confirm you have the right to post the Feedback and it does not violate others’ rights.


12) ERRORS & INACCURACIES

Occasionally, there may be errors in product descriptions, pricing, or availability. We reserve the right to correct errors and cancel orders if needed.


13) PROHIBITED USES

You may not use our Services for unlawful purposes, to infringe intellectual property, to harass others, to submit false information, or to introduce viruses or malicious code.


14) TERMINATION

We may suspend or terminate access if we believe you have breached these Terms.


15) DISCLAIMER OF WARRANTIES

To the fullest extent permitted by law, our Services and products are provided “as is” and “as available”. We do not guarantee uninterrupted or error-free operation of the Services. Perishable products may vary due to seasonal availability and handling conditions.


16) LIMITATION OF LIABILITY

To the fullest extent permitted by law, Quiet Bloom will not be liable for indirect or consequential loss arising from use of the Services or products purchased, including delays outside our control.

Nothing in these Terms excludes consumer guarantees under the Australian Consumer Law.


17) INDEMNITY

You agree to indemnify Quiet Bloom for losses arising from your breach of these Terms or unlawful use of the Services.


18) SEVERABILITY

If a provision is unenforceable, the remaining provisions continue.


19) ENTIRE AGREEMENT

These Terms and our Policies form the entire agreement between you and Quiet Bloom regarding your use of the Services.


20) GOVERNING LAW

These Terms are governed by the laws of Victoria, Australia. You submit to the courts of Victoria.
